What I like most about the law is the opportunity to make the world an easier place for people to live, to interact and to find ways to enjoy life.
When you need a lawyer, never forget that you are the client. It is only your feelings that matter—do not let an attorney intimidate you by his procedural knowledge of the system. You are the ultimately in charge of your case. If there is ever any doubt about that, just remember who pays and who gets paid.
In deciding between an out of court settlement and a trial, the likelihood of success is but part of the consideration . . . the goals and needs of the client must first be recognized, and then weighed against the inevitable costs of further litigation. Remember that the cost of litigation is not simply money and time, but that there is an enormous emotional and psychological cost to long-term controversy and conflict. A lawyer must help determine each client’s ability to tolerate these costs.
My most rewarding case is the one in which I am able to provide the client a forum in which to voice their hurt, their frustration and their anger. Recently, I helped save a family farm from foreclosure through a counterclaim against the foreclosing party. When my client realized that they were able to keep their home . . . we all were blessed by the experience.
However, I also take pride in the case that I do not take. We too often underestimate the eventual cost to the client, in terms of not only money and time, but in anguish, emotion and psychological conflict. Although I am in court every day of the week, I feel a personal obligation to explain to some clients why they may be better off not filing a lawsuit.
I would describe Haupt Law as an aggressive litigation firm that strives to “color outside the lines.” We are best at trying to avoid doing what everyone else does. We are client driven. We try to avoid doing the “lawyer-dance” of creating unnecessary billable hours. We cringe at being a subject of lawyer jokes. HBV takes seriously the opportunity we have to improve people’s lives.
My friends describe me as a good guy, sometimes generous to a fault.
My opponents describe me as focused and tenacious.
If you had to choose another profession… If I were not a lawyer, I would teach middle-school mathematics.
My favorite quote is “If you trade Freedom for Security, you deserve neither.” Benjamin Franklin (circa 1772).
My favorite book is The Fountainhead, by Ayn Rand.
My favorite sport’s team is the St. Louis Cardinals. I come from four generations of Cardinals’ fans. I remember as a kid sneaking into the ballpark because I could not afford the $1.00 bleachers seat.
I love the sound of a child (or adult) giggling. I love running water and porch swings. I love listening to my kids laugh (when they are getting along with one another).
I hate the sound of a parent yelling at their children in public.
My favorite daydream is hiking along the Appalachian Trail in eastern Tennessee.
